This page explains when you can cancel, how deposits are refunded, and what happens if something is wrong with your home. It follows the Texas Manufactured Housing Standards Act (Texas Occupations Code, Chapter 1201).
Deposits before you sign a purchase agreement
If you leave a deposit before signing a purchase agreement, you can ask for it back. Send the request in writing, by letter or email, and we’ll refund it no later than 15 days after we receive it, as Texas law requires.
There is one exception. If we special-order a home from the factory for you, it arrives as ordered, and you then refuse delivery and installation, we may keep part of the deposit. That applies only if you were given clear written notice of this rule when you ordered, and Texas law caps the amount at 5% of the home’s estimated cash price. The rest is refunded.
Your 3-day right to cancel
After you sign a purchase agreement, Texas law gives you three days to cancel it without penalty. If you finance the home, the three days start when you sign the loan documents. Tell us in writing within that time.
We then refund all the money you paid no later than 15 days after you cancel. The only costs that can be kept are for a real estate appraisal or title work on land in the purchase, and only if you asked us to arrange them after your lender’s conditional approval, were told about these rules beforehand, and received an itemized list of the costs.
After the three days
Once the three days have passed, the cancellation terms in your purchase agreement apply. If you want to know what cancelling later would cost, ask us before you sign.
Returns after delivery
A manufactured home is transported, installed and connected to utilities on your site, so homes aren’t returned for a refund after delivery and installation. If something is wrong with the home, it’s repaired under warranty.
Warranty repairs
New homes come with written warranties from the manufacturer, the retailer and the installer, as Texas law requires. The manufacturer’s and retailer’s warranties last at least one year. To ask for a repair, contact us and describe the problem; we’ll arrange it with the manufacturer or do the work ourselves.
If a warranty problem isn’t resolved, you can file a complaint with the Manufactured Housing Division of the Texas Department of Housing and Community Affairs (TDHCA).
Pre-owned homes come with the coverage, if any, stated in writing in your purchase agreement.
Services
For delivery, setup, site work and repairs, what’s refundable is set out in your written quote or agreement for that work.
